Pune: Vanchit Bahujan Aghadi ( VBA ) chief Prakash Ambedkar on Monday said that his party has filed a review petition against Supreme Court 's verdict on sub-classification of Scheduled Castes and Scheduled Tribes for reservation . Ambedkar said, "The judgment does not refer to any report or findings. There is a constitutional provision to look into the status of SCs and STs which Supreme Court has not considered.

Any inclusion, exclusion and laying down of principles is the jurisdiction of Parliament and not of the court. Therefore, we have requested Supreme Court to see if it has overstepped Parliament's jurisdiction while giving the judgment." He added that the review petition will be heard in the chamber on Tuesday.



"Society is against the verdict. We hope there will be wider discussion in Supreme Court on issues (regarding reservation) never placed before it," Ambedkar said in Pune on Monday. Supreme Court's seven-judge constitution bench on August 1 gave a 6-1 majority verdict ruling that Scheduled Castes can be sub-classified by states for providing reservation to the less privileged among them.

Four judges favoured the exclusion of the creamy layer from the SC-ST categories. The Centre turned down Supreme Court's call for a creamy layer saying that Constitution has no such provision. Ambedkar said, "If reservation is about representation of some castes, the creamy layer does not come into the picture.
