The special prosecutor in 's murder case is taking issue with the judge's choice to dismiss the actor's charges with prejudice. Kari Morrissey claimed that Judge Mary Marlowe "improperly" as she was allegedly determined to drop it from the very beginning. In a court document obtained by Deadline, she wrote: “Based on the Court’s off-record statement, it was apparent that the Court was intending to dismiss the case.

Although the Court’s final order has not yet been filed, undersigned counsel contends that the Court misunderstood the testimony on July 12, 2024, and improperly dismissed the case against Mr. Baldwin." Following the court's decision, armorer appealed to have her case revisited, an ask that Morrissey is opposing.



Hannah was previously sentenced to 18 months in prison for her alleged involvement in the death of Halyna Hutchins on the set of Rust. Alec's case was dropped after concerns over withheld evidence arose in the courtroom. The fact that they concealed it, the fact that they put it in a separate document number, didn't disclose a supplemental report, didn't disclose the bullets, didn't bring them to the April 6th evidentiary viewing. If it was that irrelevant, didn't have evidentiary value, it would have been there.

" During the trial, Crime Scene Technician Marissa Poppell was called to the stand, and in an unusual move, the judge had her physically identify different bullets from a box that had not been previously disclosed to the court, a proceeding that the jury was not present for. Poppell later confirmed under oath that these particular bullets were recorded under a separate case number and had not been presented to the defense, despite their explicit request for all pertinent evidence. Judge Sommer dismissed the jury.

In her decision to dismiss, she stated: "The state's willful withholding of this information was intentional and deliberate. If this conduct does not rise to the level of bad faith, it certainly comes so near to bad faith as to show signs of scorching prejudice." She added that there was no way for the court to rectify this wrong.
