, the former OnlyFans model accused of in their luxury condo in 2022, did not appear in court Tuesday as her attorneys blamed the prosecution for not moving the trial along. Clenney, 28, who went by Courtney Tailor on OnlyFans, has been behind bars for two years after she was arrested on second-degree murder charges in August 2022 for the death of Christian "Toby" Obumseli. "I just want to make it clear that this delay has been because of the state," Clenney's lawyer Sabrina Puglisi told the judge.

"We have been not able to move forward. My client's been in custody since January when this was filed and we have motions to recuse we need to file." Assistant State Attorney Khalil H.



Quinan shot back, saying, "We've reached out to the defense on numerous occasions to try and schedule depositions of their experts and other witnesses that they've listed in their nose for rehearing, to which they've said that they will not schedule until Your Honor rules." Tuesday's report hearing centered around allowing evidence. Clenney's defense lawyers asked that the state return the laptop at the center of computer charges against Clenney and her parents Kim and Deborah Clenney which were dropped in July.

Prosecutors previously claimed the three of them illegally accessed a laptop belonging to Obumseli after his death. Clenney's defense attorney argued the laptop was a shared device and her parents were authorized to use it. The defense argued Tuesday that since possession of the laptop was not why they were in court they needed more time to file proper motions about the device if needed.

Her father, Kim Clenney, watched the hearing Tuesday via . Both sides agreed that the next court date will be 11:30 a.m.

on September 11. has contacted Clenney's defense lawyers and Miami-Dade State Attorney's Office for comment. Clenney called the police on April 3, 2022, to report Obumseli was stabbed during an argument between them.

Police bodycam footage captured Clenney with blood all over her, claiming she stabbed Obumsel but it was an act of self-defense. She claimed the investor threw her to the ground so she picked up a knife and threw it at him from 10 feet away. However, The medical examiner ruled Obumsel's cause of death as a knife wound that punctured the subclavian artery in the right side of his chest which could not have been caused by a knife thrown from that distance.

Clenney was arrested on second-degree murder charges in August 2022 while in Hawaii recovering from substance abuse and post-traumatic stress disorder, according to the Miami Herald. After her arrest, elevator security footage from the couple's condo surfaced, showing Clenney attacking Obumseli. Her lawyer has maintained that Clenney was actually a victim of domestic abuse who defended herself in the fatal stabbing while Obumsel's family claimed she was getting special treatment because she is a white woman and Obumseli was a Black man.
