FOLLOWING a failed legal block to challenge plans for a new wellbeing resort in court, the waterpark will proceed. Therme Canada at Ontario Place will move forward after an Ontario court dismissed a lawsuit that challenged the water resort. The "all-season" attraction, which will include an indoor waterpark and thermal pools, is a project that will cost CA$ $350 million, or around $250 million.

The resort promises to offer "year-round fun for everyone," with a variety of family-friendly in-house programs. "With a combination of education, entertainment, health, and welness-based programming, as well as new parkland and access to the waterfornt, Ontario Place, will, once again, become a family-friendly destination," the site said. "This will include improved public spaces on the East Island and nearly 16 acres of public space on the West Island made possible by upgrades completed by Therme Canada.

Local Toronto-based architects, historians, and residents, however, heavily oppose the opening of the theme park .

The attraction will replace the Canadian heritage site Ontario Place , which features architect Eberhard Zeidler's Cinesphere, the world's first permanent Imax cinema. Preservationists at non-profit organization Ontario Place for All submitted a request for an environmental assessment of the West Island. The request, however, was rejected by Ontario's Superior Court of Justice on June 11.

Judges on the panel cited new legislation, the Rebuilding Ontario Place Act, as part of their ruling. The legislation, they explained, made the site exempt from an environmental assessment. "The applicant’s request for an order requiring the respondents to conduct an environmental assessment of the West Island redevelopment cannot succeed," said the judges.

Critics of the Therme project are concerned about the scale of the water park, the development group's plans to fill in an area of Lake Ontario, and the community impact of an underground parking facility. Therme Canada stated in a press release that development will include the removal of every tree on the West Island, approximately 840 trees and all vegetation, as well as the filling of all lagoons and small waterways on the island.
