Harvey Weinstein will remain in police custody as he awaits retrial on rape and sexual assault charges in New York, prosecutors have confirmed. The fallen movie mogul made a brief court appearance concerning California 's extradition request. Following the conclusion of his New York case, he is set to return to California to begin serving a 16-year sentence for another rape conviction, according to Queens District Attorney Melinda Katz.

Weinstein, who was convicted in Los Angeles in 2022 while already serving a 23-year sentence in New York , had been found guilty of two out of five felony counts in February 2020.

Weinstein's retrial in Manhattan is slated for November. Last month, Manhattan prosecutors announced their intention to level new sexual assault charges against the former film tycoon, but have yet to provide any details or a timeline for these potential new charges. During his brief court appearance, Harvey was handcuffed to his wheelchair with one hand, while the other held a book and a magazine.

His appearance in Queens criminal court lasted less than five minutes, with his lawyers agreeing that he will remain at the nearby Rikers Island jail complex. The California extradition proceedings have been taking place in Queens rather than Manhattan due to the proximity of the Queens courts to Rikers Island. After being hospitalized in July for health issues including COVID-19 and pneumonia in both lungs, Harvey has since returned to Rikers Island.
