Two professional engineers have been charged with endangering workers under Ontario’s Occupational Health and Safety Act, in relation to two partial collapses of Evertrust Developments’ Upper Vista Welland condo project early last year. The Ministry of Labour said in an email the two were charged on Aug. 15 under Section 31 (2), “as a professional engineer, did, as a result of advice negligently or incompetently given, endanger a worker or workers at a workplace.
” Despite requests to name the two, the Tribune was not provided that information by the ministry. It said the two first appeared in Provincial Offences Court in Welland on Sept. 26 and the matter was adjourned to Dec.
12. “As this matter is currently before the court, the ministry is unable to comment further,” said the email from the ministry’s issues management and media relations team. The ministry, which issued 21 orders and requirements to Evertrust since the two collapses at 350 Prince Charles Dr.
S. in February 2023, said its investigation is ongoing and had no new information to share. Offences in Provincial Offences Court are not considered criminal in nature.
Convictions do not result in criminal records. Joyce Morocco, a contracted spokesperson for Evertrust Developments, said company officials were unaware of the ministry charges. “We’re still waiting for the final official report (on the collapses),” she said Thursday.
