New Delhi: The Delhi Saket Court on Friday directed the Delhi Police to register an FIR against two former employees of an eminent fashion designer Pallavi Mohan for criminal breach of trust. “This court has no hesitation to hold that the cognizable offence of criminal breach of trust by a servant, punishable u/s. 408 IPC is clearly seen to be committed by the alleged Manu Uniyal and Surender Kumar”, judicial magistrate first class Akshay Sharma said while directing the Station House Officer of Okhla Industrial Area police station to register an FIR.
Mohan who is the owner of a brand “Not So Serious” had filed a complaint alleging that her former employees Uniyal and Kumar, during their employment, took orders of ladies garments from her clients and provide them clothes using her brand name. The court also observed that proper filed investigation is necessary in the case as the vendors and buyers are also to be examined. The court while going through the action taken report filed by the Delhi police noted the submission that trade mark violation could not established during the enquiry.
However, the court directed that if during the investigation, commission of offence under Trademarks Act is surfaced, then investigation may be transferred. The court has called for a compliance report to be filed on October 18. It was further alleged by her that the duo were illegally manufacturing clothes using Mohan’s designs and other resources and have been selling them with her.
