The court was told the defendant's van was spotted in the Oaks Road area of Dungannon and later stopped in vicinity of Lambfield Meadows at approximately 11.40am. Prosecuting counsel said police officers smelled intoxicating liquor and the defendant failed a preliminary breath test and was arrested.

Counsel said he was taken to Dungannon custody suite, where he provided a specimen showing an alcohol reading of 94mcgs in breath. Jarlath Faloon, solicitor, said the defendant admitted the offences and it was his second conviction within 10 years.

He said the defendant is insured to drive the family car but the van he was driving was in his wife’s name. The solicitor pleaded with the court to be lenient with the defendant.
