KITTANNING — Charges have been waived for court against an Indiana County resident. On Oct. 23, Dennis Dale Lewis Jr.

, 40, of Indiana, elected to waive his right to a preliminary hearing, a move that prompted Kittanning Magisterial District Judge Kenneth Bussard to bind the case over to the Armstrong County Court of Common Pleas. Lewis has been charged with third-degree felony retail theft-taking of merchandise and third-degree misdemeanor defiant trespassing. According to the affidavit of probable cause filed by State Police Troop D, Kittanning, Trooper Zachary C.



Swartz, on Aug. 22 at approximately 3:47 p.m.

the trooper responded to a report of retail theft at a business in East Franklin Township. Allegedly, on Aug. 14 at approximately 6 p.

m., Lewis entered the business after being issued a notice of trespass and took several items without paying for them. According to court documents, Lewis has had six other prior retail theft convictions.

He is confined to Indiana County Jail because he could not post $5,000 bail..
