The program requires the California Civil Rights Department (CRD) to initiate the mediation within 60 days following a request, prohibits an employee from pursuing a civil action, and tolls the statute of limitations (including for all related claims not subject to mediation) from the date of receipt of the request to participate in the program until the mediation is complete or the mediation is deemed unsuccessful. AB-2011 expands the program to include allegations regarding reproductive loss leave and extends the program indefinitely. The pilot program is scheduled to expire on 1 January 2025.
