Pune: Special public prosecutor Shishir Hiray on Friday told the Bombay high court that no coercive action would be taken against the labour contractor — the father of one of the two minors accompanying the minor Porsche car driver at the time of the accident on May 19 — till his anticipatory bail application was decided. The single bench of Justice Manish Pitale then deferred its final order on the contractor's bail plea till Oct 9. The contractor had moved the high court after the special court in Pune rejected his anticipatory bail application.
The prosecution's case is that the contractor had swapped the blood sample of his minor son with that of his friend (a jeweller), arrested on Aug 19. The prosecution had accused the contractor of committing an offence of conspiracy, destruction of evidence and forgery. The contractor's lawyers, Aabad Ponda and Abid Mulani, told the high court that the charges related to conspiracy and destruction of evidence were bailable and there was nothing to show that their client had committed forgery.
The lawyers sought adjournment to submit written notes of arguments and documents. Prosecutor Hiray, on the instruction of assistant commissioner of police (crime) Ganesh Ingale, made the statement before the high court that no coercive action would be taken against the contractor till his bail plea was decided..
