Halle Berry is seeking sole custody of her and Olivier Martinez ’s 10-year-old son, Maceo. Per court documents obtained by People , Berry, 58, is requesting custody, “or in the alternative, tie-breaking authority to make all decisions” about his education, health and therapy. In the Friday, August 16, docs filed in the Superior Court of California in Los Angeles County, Berry alleged she tried to address Maceo’s “educational challenges” and behavioral concerns.

The filing claimed she “fought for tutoring, an educational assessment and finding an environment that was suitable to Maceo’s needs.” Per the docs, Martinez, 58, was allegedly “oppositional, unmoving and withheld his consent for years.” “Because of Respondent’s opposition to any interventions whatsoever for years and because of Respondent’s prioritizing soccer activities over Maceo’s educational and psychological well-being, Maceo’s educational and behavioral challenges worsened, and he continued to fall further behind in school,” the filing read.

Berry claimed that Maceo would “act out” after “longer periods of custody” with Martinez, noting that their son would “repeat disputes” that were private between the former couple. Per Berry, Martinez claimed Maceo was “old enough to make his own decisions.” In the filing, Berry argued that Martinez “ignores the professionals hired to help Maceo, and he aggressively stands in the way of implementing strategies and intervent.
